The aim of data protection, as well as of WOW! Würth Online World GmbH is to handle personal data in such a way that the personal rights of the individual are protected.

Entities responsible for the processing of personal data are obliged to comply with the regulations from the EU legislation (EU General Data Protection Regulation - EU GDPR) as well as the national laws on data protection.

Personal data may only be collected and processed if it is explicitly permitted by the EU GDPR.

Determining the purpose of the collection, processing or use of data

We are specialists in multi-brand diagnostics, air conditioning service and emissions testing. We offer our customers suitable diagnostic solutions for car diagnostics, air conditioning service units and emission measuring instruments. Together with our customers we create an individual package of hardware, software, hotline and training.

Personal data is collected, processed or used to fulfill this corporate purpose or supporting secondary purposes, such as customer consulting or the further development of technical diagnostic solutions for our customers.

We thus collect, process and use personal data exclusively for the preparation and fulfillment of contracts, out of legitimate interest, to comply with legal obligations or with the consent of the person concerned.

How do we collect your data?

Your data is collected on the one hand by you providing it to us. This can be, for example, data that you enter in a contact form or provide us for the preparation of an offer. The provision of data is voluntary and subject to your decision.

Other data is automatically collected by our IT systems when you visit the website. These are mainly technical data (e.g. Internet browser, operating system or time of page view). The collection of this data takes place automatically as soon as you enter our website.

What do we use your data for?

Data that is collected personally from you and not via the website is used to create the customer number, order processing but also for your support and sending newsletters, offers and service offers.

Legal basis for processing

Processing personal data is only lawful if it is permitted by a law, that is to say, if there is a legal basis for it. However, further options are defined both in the EU GDPR and the FDPA.

Personal data is only processed in our company in compliance with legal regulations. These are, among others

  • When a consent to processing personal data has been given (Art. 6 sect. 1 a EU GDPR)
  • When personal data must be processed to fulfill a contractual obligation or to prepare a contractual relationship (Art. 6 sect. 1 b EU GDPR)

When considering the interests of the data subjects or the parties to the contract, very stringent criteria to the benefit of the data subject will be used.

Potential recipients of data transfers

Potential recipients of transmitted personal data are

  • Public entities in case a legal obligation is in place
  • Service providers and other business partners if it is required to fulfill the individual purposes and a legal regulation permits or demands it or if the data subject has give his/her consent

Planned data transfer to third countries

If data transfer to third countries is required, this shall exclusively be done for concluding or complying with contracts - as far as the legitimate interest of the data subject does not oppose this - considering all data protection requirements. If the intention to transfer personal data to a third country or an international organization exists, this shall be done on the basis of an adequacy decision. If data is transferred nevertheless, we recommend that adequate guaranties or binding internal data protection regulations be in place and/or, when considering interests of data subjects and the contracting parties, strict criteria to benefit data subjects be applied.

Time limits for the erasure of data

Personal data will be deleted in accordance with the legal or contractually established regulations on the disposal of data and considering any legal or contractually established retention periods. Most of these legal requirements are based on the German Commercial Code (HGB) and the German Fiscal Code (AO). The retention and documentation periods set out in these codes require data controllers to retain data for up to ten years after the end of a business relationship or pre-contractual legal transaction.

Other legal provisions may impose even longer retention periods on data controllers, for instance for the retention of evidence in accordance with statutory limitation periods. The general limitation period is three years. Special limitation periods of up to 30 years or longer may, however, apply in certain situations. Personal data, which is not subject to a legal or contractual retention period or erasure obligation, must be deleted immediately after it is no longer necessary in relation to the purposes for which it was collected or otherwise processed.

Your rights regarding data protection

The data subject has various data protection rights. These rights are explained below. The contact details set out above can be used to exercise these rights.

Right of Access (Art. 15 EU GDPR), Right to Rectification (Art. 16 EU GDPR), Right to Erasure (Art. 17 EU GDPR), and Right to Restriction of Processing (Art. 18 EU GDPR)

Subject to the applicable legal regulations, you have the right to obtain information, at any time, free of charge, about all your personal data stored by the data controller, its origin, recipients and purpose of storage as well as, where applicable, the right to rectification, erasure or restricted processing of your data.

Right to object (Art. 21 EU GDPR)

Every data subject has the right to object to the processing of their personal data on the basis of Art. 6 sect. 1 f EU GDPR or for direct marketing purposes. Upon receiving an objection to the processing of your personal data, we will carefully review your objection in each individual case. If your objection to the processing of your personal data requires us to delete your data, we will delete your data in accordance with statutory retention requirements. The objection shall not affect the admissibility of the processing carried out up to the objection.

Right to data disclosure

Every data subject has the right to know whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether the data subject is obliged to provide the personal data and what the possible consequences of failure to provide such data would be.

Right to data portability

If you request the direct transmission of the data to another controller, this will only be done if it is technically feasible.

Revocation of your consent to data processing

Legal basis

The processing of personal data is carried out for contractual purposes. The legal basis for processing for these purposes is,

1. if you are a registered businessperson within the meaning of the German Commercial Code (HGB) or a freelancer, processing your personal data is necessary for the performance of the contract or for the preparatory steps to enter into a contract (Art. 6 sect. 1 b EU GDPR);

or

2. if you act as an employee of a company, e.g. as an employee in purchasing, Art. 6 sect. 1 f EU GDPR, the legitimate interest of WOW! Würth Online World GmbH in preparing the sale of products or services.

Retention period

The customer data collected will be deleted after the order has been processed or the business relationship has ended. Legal retention periods will remain unaffected.

Data transfer when concluding contracts for customers, dealers

We only transfer personal data to third parties if this is necessary to fulfill the contract. We transfer it for instance to the companies entrusted with shipping the merchandise or the bank commissioned to handle the payment. No further data is transmitted and/or only if you have expressed your explicit consent. Your data is not disclosed to third parties, for instance for advertising purposes, without your explicit consent.

In the case of a leasing inquiry, we will send the data required for the leasing inquiry, only with your consent, to our leasing partner: Würth Leasing GmbH & Co. KG. Of course, leasing inquiries can also be processed via leasing companies and / or banks of your choice.

Data transfer for service, service requests and service orders

When contacting our service or hotline team (by telephone or e-mail), the contact data transmitted can be used for the current inquiry as well as for other digitally transmitted processes in order to forward the inquiry to the responsible internal department or, in the case of a repair or complaint, to the respective supplier or to the repair company commissioned by us. This is to ensure the proper handling of these business transactions and to guarantee faster processing of customer inquiries. The contact data provided is transferred to our customer database for this purpose and stored there.

The personal data processed in this context will be stored for the duration in which you are in a business relationship with us or until you request us to delete it. Legal storage obligations remain unaffected.

In accordance with the requirements of Articles 13 and 14 of the European General Data Protection Regulation (EU GDPR), we hereby inform you about the processing of personal data provided by you as part of the application process and, if applicable, collected by us, and about your rights in this regard.

Purposes and legal bases of processing

We process your personal data in accordance with the provisions of the European General Data Protection Regulation and the German Federal Data Protection Act, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is Art. 88 EU GDPR in conjunction with § 26 BDSG and, if applicable, Art. 6 sect. 1 b EU GDPR for the initiation or implementation of contractual relationships.

If an employment relationship arises between you and us, we may, in accordance with Art. 88 EU GDPR in conjunction with § 26 BDSG-new, further process the personal data already received from you for the purposes of the employment relationship, insofar as this is necessary for the implementation or termination of the employment relationship.

Recipient of the data

We only pass on your personal data within our company to those persons who need this data to fulfill contractual and legal obligations or to implement our legitimate interests. Data will only be passed on to recipients outside the company if this is permitted or required by law, if the transfer is necessary to fulfill legal obligations or if we have your consent.

Retention period

We store your personal data as long as this is necessary for the decision on your application. Your application documents with the personal data will be deleted a maximum of six months after the end of the application process (e.g. the announcement of the rejection decision), unless longer storage is legally required or permitted. We store your personal data beyond this only insofar as this is required by law or in the specific case for the assertion, exercise or defense of legal claims for the duration of a legal dispute.

If an employment relationship, apprenticeship or trainee relationship is established following the application process, your data will initially continue to be stored insofar as this is necessary and permissible and will then be transferred to the personnel file.

This website uses SSL and/or TSL encryption for security reasons and to protection the transmission of confidential content such as orders or requests that you send to the website's operator. Joint responsibility for the processing of Page Insights Data

We have concluded a joint controllership agreement with Facebook for the processing of data in connection with our Facebook profile (our so-called “Page”), the provision of our profile and the statistical analysis of interactions by Visitors to our profile. This agreement sets out the obligations we and Facebook have to meet in connection with data processing activities and which party is responsible for individual processing activities.
